Nature’s Sunshine Products Poland Subscription Terms and Conditions

1. GENERAL

  1. The NSP Online Shop, available at e-naturessunshine.com, is an ICT platform allowing the conclusion of Distance Selling Contracts as well as provision of services by electronic means, operated by:

    Nature’s Sunshine Products Poland Sp. z o.o. with its registered office in Warsaw, ul. Olkuska 7, 02-604 Warsaw, entered in the Register of Entrepreneurs kept by the District Court for the Capital City of of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, KRS: 0000248004; NIP: 108-000-53-70; REGON: 140331748; share capital of PLN 50,000.00 (contact details: e-mail: biuro@nsppolska.pl, phone: +48 (22) 311 21 00 - charge as for a standard call - operator’s rates apply) (hereinafter also referred to as the “Service Provider” or “Seller”).

  2. These Terms and Conditions are addressed to Consumers using the Online Shop. The regulations of these Terms and Conditions are not intended to exclude or limit any rights of Consumers under mandatory provisions of law - any possible doubts shall be interpreted in favour of the Consumer. In the event of any inconsistency between the regulations of these Terms and Conditions and the aforementioned provisions, the provisions shall prevail.
  3. The Seller is the controller of personal data processed in connection with the implementation of the regulations of these Terms and Conditions. Personal data shall be processed for the purposes and within the scope of, and based on the principles indicated in the privacy policy published in the Online Shop. The provision of personal data is voluntary, however, failure to provide it shall prevent Order processing and use of all Electronic Services. Any person whose personal data is processed in connection with the use of the Online Shop shall have the right to inspect its content and the right to update and rectify it. Consent to personal data processing can be withdrawn at any time.

2. DEFINITIONS:

  1. Customer – the natural person placing an Order, including using the Product Subscription service.
  2. Seller – Nature’s Sunshine Products Poland Sp. z o.o., ul. Olkuska 7, 02-604 Warsaw, District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register KRS 0000248004; NIP 108-000-53-70; REGON 140331748; share capital of PLN 50,000.00, e-mail: biuro@nsppolska.pl, phone: +48 (22) 311-21-00 (charge as for a standard call - operator’s rates apply).
  3. Order – agreement with the Seller to supply the Product/Products in the agreed quantity and in accordance with the established terms of delivery and payment.
  4. Product/Products – goods held for sale by the Seller.
  5. Product Subscription – registration made voluntarily by the Customer to the cyclical delivery of the Product/Products on the day of the month selected by the Customer.
  6. Subscription Period – the period during which the Order is shipped.
  7. Contract – a legal act of sale concluded between the Customer and the Seller.

3. GENERAL PROVISIONS OF SUBSCRIPTION

  1. Product subscription at Nature’s Sunshine Products Poland (hereinafter referred to as the “Subscription”) allows Customers to regularly enjoy their favourite products with the bonus of a reduced selling price - 10% lower than the retail price. Promotional subscription sets and products are not subject to a 10% discount.
  2. Only registered customers of Nature’s Sunshine Products Poland are entitled to use the Subscription.
  3. The Customer may not reduce the subscription basket cost with a wallet discount.
  4. The Subscription is intended for product users and natural persons. Invoices issued to natural persons shall be created for deliveries, while invoices issued to a company are not an option.
  5. These Terms and Conditions set out the rules of using the Subscription.
  6. Using the Subscription shall be tantamount to accepting all the regulations of these Terms and Conditions.

4. SUBSCRIPTION ORDER CONDITIONS

  1. Follow these steps to order automatic shipping (Subscription):
    - select the Subscription option in the price field on the tab of any product;
    - move to editing your subscription and add your favourite products to the subscription basket;
    - provide permanent shipping address and details;
    - carry out the authorisation process of the card to be used to pay for the recurring shipping order.
  2. Each Customer can only submit one automatic shipping order per month. The Customer can schedule shipping between the 1st and 25th day of the month.
  3. The value of the ordered products must not exceed PLN 800 or EUR 200.

5. DELIVERY COST, LEAD TIME AND METHODS

  1. Free shipping under Subscription shall be available for orders over PLN 200 or EUR 50. Delivery prices below this value correspond to the delivery price list. 
  2. The Order lead time is 1 to 3 working days.
  3. The Order shall be dispatched by the carrier selected by the Customer when ordering the Subscription.
  4. If a product is not available at the time of shipping, the part of the subscription delivery which is in stock shall be processed, while the unavailable goods shall be sent as soon as possible after stocks are replenished.

6. PAYMENT METHOD

  1. Fixed, defined amount monthly payments made on a user-defined day of the month for any defined basket of products.
  2. Payment card details must be entered only once in the case of recurring payments.
  3. Card confirmation via PayU requires the transfer of 1 PLN which will be refunded after successful verification. It is a standard procedure to ensure the authenticity of the payment card and the user’s authority to make transactions.
  4. The user can suspend or delete recurring payments and Subscription at any time.
  5. If the card authorisation process is not completed, the shipping order shall not be processed

7. SUBSCRIPTION CHANGES AND CANCELLATION

  1. Changing the products in the Subscription basket shall mean withdrawing the existing automatic shipping order and creation of a new order.
  2. Changing the subscription basket shall require repeating the payment card authorisation process.
  3. It is possible to cancel or skip the Subscription at any time until payment for the next shipment is authorised. Cancellation can be done via the online shop under the Subscription – Cancel Subscription tab.

8. OTHER PROVISIONS

  1. A subscribed Customer can still place single orders and benefit from all promotional campaigns applicable at the Nature’s Sunshine shop.
  2. Subscriptions points are added to points required for other promotional campaigns, e.g. the Loyalty Promotion.
  3. If a new customer does not collect their first subscription delivery, their Subscription order shall be cancelled.
  4. Points for uncollected subscription delivery shall be cancelled.
